Terms of Use

By submitting case data to Cancer Case you accept and confirm the following Terms of Use of Cancer Case:

  • All case data submitted by me are correct, complete and unaltered.
  • All case data submitted by me are real and unaltered data of real patient cases.
  • I am entitled to submit case data to Cancer Case, in particular according to the organisational rules of my hospital / university.
  • I agree that Cancer Case electronically (via internet / app) or otherwise (also in aggregated form) publishes all case data submitted by me and keeps such data accessible for third parties. All rights, of whatever kind, in the case data submitted are transferred and furthermore held exclusively by Cancer Case. Apart from a plausibility check to avoid obvious input errors Cancer Case will not alter the case data submitted to it, but only publish them.
  • I guarantee that the identity of the patient whose case data are submitted to Cancer Case by me cannot be determined / are not determinable or that the patient has consented to the submission of his / her case data to Cancer Case.
  • As far as I have made the respective choice upon entering my personal data, I agree that I Cancer Case contacts me if another user wants to ask me for additional information. It will be my own independent decision, whether I contact such another user (I am not obliged to do so); however I will refrain from any other use of the personal contact data of other users which are provided to me by Cancer Case. I am entitled to withdraw this consent at any time and can – alternatively – submit all data anonymously. In addition Cancer Case will only store data necessary for the submission and / or the use of case data, i.e. name, address, department, field, specialisation, email-address.
  • Upon registration with Cancer Case my identity shall be verified by submitting of a (physician’s) ID to Cancer Case. The purpose of this procedure is to ensure that case data can only be submitted by physicians and only be retrieved by health care professionals. After their verification Cancer Case will delete the ID data and will not use them for other purposes.
  • Cancer Case retains the right to delete case data for any reason, in particular if access to Cancer Case is abused and / or the Terms of Use are violated.
  • The submission of case data to Cancer Case shall not affect my duty to report side effects (e.g. according to §§ 75g ff of the Austrian Federal Act on Medicines – Arzneimittelgesetz). Cancer Case will not report side effects based on case data.
  • Cancer Case retains the right to block any user‘s access (for both submission of cases and / or for the retrieval of data) for any reason, in particular if access to Cancer Case is abused and / or the Terms of Use are violated.
  • By retrieving case data from Cancer Case you accept and confirm the following Terms of Use of Cancer Case:
  • Cancer Case only publishes case data only as they are submitted by participating physicians / health care professionals and does not alter the content. Cancer Case does not process any case data.
  • Cancer Case does not know the identity of patients whose cases are submitted to it.
  • Apart from a plausibility check to avoid obvious input errors Cancer Case will not alter the case data submitted to it, but only publish them. Therefore Cancer Case does not assume any warranty, liability and / or guarantee, of whatever kind, for the completeness, integrity and / or accuracy of case data.
  • All rights, of whatever kind, in the case data are exclusively held by Cancer Case. Apart from the scientific assessment of certain cases and / or the medical treatment of individual patients all use of data is subject to the advance written consent of Cancer Case.
  • In particular Cancer Case does not assume any warranty, liability and / or guarantee, of whatever kind, for medical decisions, diagnoses and / or therapies, which are applied based on Cancer Case - data. Each case has to be assessed by qualified physicians and each medical decision based on any case data has to be made according to the standards of medical science.
  • Cancer Case encourages the use of Cancer Case data in science and medical practise. Upon use of Cancer Case data for scientific purposes (e.g. articles, presentations, posters etc.) a reference to Cancer Case (including the case identification) is obligatory.
